Just when you think you’ve seen about everything, a citizen panel in rural Tulare County has stated the obvious: California’s crazy quilt of do-it-yourself city and county cannabis cultivation laws isn’t working. Tulare County supervisors, early adopters that they are, have passed an urgency ordinance prohibiting Tulare County dispensaries and medical cannabis collectives involving two or more people. Meaning just about everyone. UPDATE: The 45-day ordinance was extended for another 22 months, 15 days by the Board of Supervisors on April 23, 2013. Fresno’s ban on outdoor cannabis gardens faces a new legal challenge, this time on environmental grounds. In December 2011, the Fresno City Council passed a so-called urgency ordinance prohibiting outdoor cannabis gardens anywhere in the city. The ordinance passed after police cited concerns about a handful of large-scale gardens, some of them within residential neighborhoods. The deal is done and the ink has dried on Fresno’s permanent ban on growing marijuana outdoors. Technically speaking, it doesn’t take effect until Aug. 3, but there’s a temporary ban that’s still in place. The Fresno City Council voted Thursday to approve a permanent ban on growing medical marijuana outdoors. The measure now goes to Mayor Ashley Swearengin for her signature, and it takes effect 30 days after that. The permanent ordinance allows no outdoor marijuana cultivation of any kind within the city limits, just like the temporary bans that were passed in December and January, the latter of which is still in effect. The Fresno City Council voted 5-0 today to approve a permanent ban on growing medical marijuana outdoors. (It’s on the June 28 council agenda for second reading and final passage.) The ordinance allows no outdoor marijuana cultivation of any kind within the city limits, just like the temporary bans that were passed in December and January. Enforcement will be handled through a civil injunctive process, with each day of non-compliance counting as a separate violation. [read more …]
