A Fresno man fired a shotgun to protect his backyard medical-marijuana garden from thieves, both sides agreed Friday as the man’s trial opened in Fresno County Superior Court. But they disagreed about whether Phayvanh Dydouangphan murdered one of the intruders — Stanley Wallace — or shot him in self-defense. A Tulare County judge on Tuesday ruled in favor a medical marijuana collective near Ivanhoe by saying that that it can stay open. But the county, which sued the collective in October to try to shut it down, said it will seek a trial to try to win the case, the Fresno Bee reports. Twenty-five pounds of marijuana and a pound of hashish oil were seized by police Monday night in a central Fresno alley. Fresno police Sgt. Bob Reynolds said officers went to the alley on the 3200 block of East Clinton Avenue about 6 p.m. because of reports of drug sales there. It was Dec. 7, Pearl Harbor day, when the sheriff and the feds convinced Fresno County to ban medical marijuana dispensaries. The bomb was dropped by the Board of Supervisors on a packed house of collective operators and patients, but it wasn’t a surprise. The same board banned outdoor cultivation in September, but a judge stayed enforcement until Nov. 30 so that plants could be harvested. After a long and sometimes contentious public comment period, Fresno County supervisors voted Tuesday to draft an ordinance that will ban medical cannabis dispensaries permanently. No formal action was taken in Tuesday’s morning session, which had stretched well past noon before the last speaker was heard, but staff were directed to prepare a ban for later public hearing.
